All charges have been dropped against a former Morgan Hill Golf Course employee accused of costing the Williams Township golf course money and taking trade secrets and vendors to a golf course in New Jersey.

Patrick D. Mallory, of the first block of Oakwood Drive in Wayne, New Jersey, was charged in April with nine felony theft counts and one count of converting trade secrets. Mallory was previously a golf pro at the club at 100 Clubhouse Drive.

Following a two-hour preliminary hearing in May, District Judge Daniel Corpora dismissed the covert trade secrets and theft by unlawful taking charges against Mallory.

That left eight theft charges stemming from individual golfers sold punch card passes to Morgan Hill by Mallory, Northampton County Assistant District Attorney Jim Augustine said.

The district attorney’s office reached out to the victims, and those that responded were either made whole or were being made whole outside of court, Augustine said.

“It was not a strong case,” as evidenced by a neutral district judge dismissing the two, more serious charges, Augustine said.

There is a civil litigation piece to this case.

“He brought in a lot of business to Morgan Hill,” Augustine said. There was a business dispute, and Mallory went to work at a golf course in New Jersey, the prosecutor said.

Mallory does not have a prior criminal history, and with the victims being compensated without a judge’s order, “I really felt their dispute should be settled in civil court. I didn’t think it was a case we should use criminal law,” Augustine said.

On Sept. 21, Judge Sam Murray approved dropping the remaining eight charges against Mallory.

“I think justice was done," Christopher Shipman, Mallory’s defense attorney, said.

Course General Manager Rosann Lapio, whose family owns the club, previously told state police that while she and Mallory discussed the punch card program, she was unaware Mallory started the program and was selling the cards for $125 a piece.

A purchaser would pay for five rounds of golf and get a sixth round free. Lapio went to state police after customers came to the course in 2018 and asked for free rounds of golf, troopers said.

The total loss for the 661 free rounds of golf was $31,845, “but Lapio estimates the total loss to the company to be $82,000 from products/service not paid for,” police said.

Mallory was fired after a a separate incident where Lapio found files that were scanned at the club and sent to an “outside person”, state police said.

The files included financial information, customer information and contact information for suppliers and industry professionals, police said. It was not public information and should only have been seen by course management, Lapio told investigators.

The files were scanned to Mallory’s company email during his scheduled shift and showed up in the scanner’s history, police said.

The “confidential” information was sent to Mallory’s business partner, police said.
