Allegedly Attacked Victim With Golf Clubs Before Shooting, Kicking Him.

UPDATE 12:41 p.m. Monday, April 25, 2022: We just received the arrest report from the Palm Beach County Clerk of Courts. We are publishing the report, written by the arresting PBSO Deputy, in its entirety. We note that suspect Robert A. Levine shares the same name as another Kings Point resident arrested for an attack on a neighbor several months ago. This arrest, according to PBSO, is a different Robert A. Levine. The Robert A. Levine arrested Sunday is 74 years old. The Robert A. Levine arrested in November for attacking a resident with a pool cue is younger.

POLICE NARRATIVE

On Sunday, April 24th, 2022, at approximately 1850 hours, Deputies responded to the 600 block of Flanders M, within the Kings Points community located in unincorporated Delay Beach, in reference to a shooting that just occurred. PBSO communication received numerous calls referencing a male shooting another male at hole 15 of the Kings Point golf course. The shooter was described as a heavy set white male wearing a tan shirt and a hat.

Deputies responded and located a male matching the same physical description standing near hole 15 of the golf course. He was subsequently detained by responding Deputies. He was eventually identified as Robert Levine. Deputies conducted a frisk of the subject, and discovered a black semi-automatic handgun in his front left pocket. Also on scene was a white male, later identified as Herbert Merritt, who was suffering from a gun shot wound to his left ankle, as well as several apparent abrasions to the
left side of his body and left arm. Both Merritt and Levine were subsequently transported to the Delay Medical Center for treatment. Detectives from the Violent Crimes Division were summoned to the scene to futher investigate the incident. I responded to Delay Medical Center, while assisting Detectives responded to the shooting scene.

In speaking with Merritt, he said that he was walking his dog in the grass next to the golf course. Unprovoked, a male, identified as Levine, drove to him on his golf cart and began causing a verbal altercation with him due to having his dog on the golf course. Merritt said that during the altercation, Levine produced a firearm and pointed it at him. He then began shooting at him while Merritt was running away.

Levine chased Merritt around a tree in the area while continuing to shoot. Merritt said that he was struck with a bullet one time in his left ankle, causing him to fall on to his face. Merritt believes that Levine fired approximately five rounds at him. Levine then returned to his golf cart and armed himself with a golf club. Levine engaged Merritt again and struck him at least four times with the golf club on his body and arm. Merritt said he was yelling for somebody to call 911, as he was unable to move from the area due to his injury. Merritt confirmed that at no time did he do anything to provoke Levine nor has he ever seen him before. Merritt said that he felt that Levine was trying to kill him.

(Witness #1) spoke with detectives, and in speaking with him, he said that he was sitting on his balcony when he observed the verbal altercation take place between Levine and Merritt. (Witness #1) said that he heard Levine yelling at Merritt for walking his dog on the grass. He then watched as Levine produced a firearm and began shooting at Merritt, striking him at least one time. He said that when Merritt fell, Levine kicked Merritt in the head, and then went to the golf cart and retrieved a golf club and began
to strike Merritt while he was on the ground.

(Witness #2) spoke with detectives, and in speaking with her, she said that she was laying in bed when she was alerted to a gun shot sound coming from the rear of her residence. She stated that she saw Levine chase Merritt around the tree while shooting at Merritt. She was unsure how many times Levine was shooting, but knew it was several. She further said that she observed Levine retrieve a golf club and began striking Merritt. She added that while Levine was holding the golf club with his right hand, and holding the firearm in his left hand. Four 9mm shell casings were recovered on the ground on scene, along with two golf clubs with blood-like substance on the face of the clubs, and a black Springfield Armory 9mm gun.

Based on the above, I find probable cause to charge Robert Levine with the following offenses, per Florida State Statute: Attempted 1st Degree Murder with a firearm, Aggravated battery with a weapon, and Discharging a firearm in public.

From PBSO:

“On Sunday, April 24th, 2022, at 1650 hours, Deputies and PBCFR responded to the 600 Block of Flanders M (Kings Point) in reference to a shooting. Deputies located a white male with a gunshot wound to his left ankle. A white male, later identified as Robert Levine, was also located on scene, who later determined to be the suspect.”

“The victim was transported to Delray Medical Center for non-life threatening injuries. The suspect was also transported to Delray Medical for injuries unrelated to the shooting. The investigation revealed that the suspect shot the victim during a verbal altercation over the victim’s dog walking on the golf course of the community.”

We expect more information later in the day, once the arrest report is processed by the Palm Beach County Clerk of Courts.
